The Advisory Committee Notes to Rule 2013 establish that its reporting requirements do not apply to chapter 12 or chapter 13 trustees. These reports therefore include only chapter 7 and chapter 11 trustees and their professionals. Additionally, while chapter 11 debtors-in-possession have certain powers of trustees, see 11 U.S.C. § 1107, compensation paid to professionals employed by chapter 11 debtors-in-possession is not reported, though compensation paid to professionals employed by chapter 11 trustees is reported.
The Court has tried to ensure the accuracy of these reports. However, the data for these reports comes from the Electronic Case Filing (ECF) system. The Court has identified certain errors and omissions caused by the ECF system and how trustees and other ECF users docket their pleadings and papers, including the fact that the ECF system does not track chapter 7 fees in no-asset cases. Steps have been taken to address certain of the errors that have been identified by the Court. However, the monthly reports do not include the fees associated with no asset cases. In addition, professionals are listed by the name(s) used in the ECF docketing process. This at times results in separate entries for lawyers within the same law firm, for auctioneers under a personal as well as trade name, and similar anomalies.
